1. Acceptance of Terms

By creating an account and using the NETO AI platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our services.

2. Account Registration

To access NETO AI, you must create an account by providing certain information, including but not limited to an email address, username, and birthdate. You agree to provide accurate and up-to-date information and to keep your account details secure.

You are responsible for maintaining the confidentiality of your account credentials, and you agree to notify us immediately if you suspect any unauthorized use of your account.

3. Use of Service

You agree to use NETO AI only for lawful purposes and in accordance with these Terms and Conditions. You are prohibited from:

  • Violating any applicable laws or regulations.
  • Impersonating another user or entity.
  • Engaging in any activity that could harm or interfere with the functionality of NETO AI or its users.
  • Using the platform for illegal or harmful activities, including but not limited to harassment, abuse, or infringement of intellectual property rights.

4. Prohibited Activities

You agree not to:

  • Publish or create Not Safe For Work (NSFW) content using NETO AI, including, but not limited to, sexually explicit, offensive, or harmful material.
  • Engage in spamming, phishing, or any form of unauthorized data collection.
  • Reverse-engineer, decompile, or disassemble the NETO AI service or its code.
  • Attempt to gain unauthorized access to any part of the service or to any user accounts.

5. Intellectual Property

NETO AI and its contents, including but not limited to text, graphics, logos, images, and software, are owned by NETO or its licensors and are protected by intellectual property laws.

However, user-generated content (such as characters, designs, or other creations) remains the property of the user who created it. By submitting or publishing any content on NETO AI, you grant NETO a limited, non-exclusive license to use, display, and distribute your content solely for the purpose of operating the platform.

You retain full ownership and intellectual property rights over your creations, and NETO does not claim any ownership over your user-generated content.

6. Subscription Model: NETO AI+

NETO AI offers a subscription service called NETO AI+ that provides additional features and benefits. By subscribing to NETO AI+, you agree to the following terms:

  • Subscription Fees: Access to NETO AI+ is available for a recurring fee, which will be charged to the payment method you provide at the time of subscription. Subscription fees are subject to change, and we will notify you in advance if any changes are made.
  • Billing Cycle: Subscription fees will be billed on a [monthly/annual] basis, depending on the plan you choose.
  • Automatic Renewal: Unless you cancel your subscription, your NETO AI+ subscription will automatically renew at the end of each billing cycle. You can cancel your subscription at any time through your account settings.
  • No Refunds: Subscription fees are non-refundable except as required by applicable law.
  • Benefits of NETO AI+: Subscribing to NETO AI+ grants you access to the following exclusive features:
    • Skip Waitline: During periods of high platform usage, NETO AI+ subscribers can bypass wait times for faster access.
    • Improved Memory: NETO AI+ subscribers enjoy enhanced memory capacity, allowing for more detailed and longer interactions.
    • Faster Response Time: NETO AI+ subscribers experience quicker response times, providing a more seamless and efficient experience.
    • Early Access: NETO AI+ subscribers gain early access to new features, updates, and exclusive content before it’s available to the general user base.

7. Experiences (3D Worlds)

NETO AI offers immersive 3D worlds, referred to as “Experiences”, where users and their characters can interact in a virtual environment. These Experiences are designed by NETO and offer a dynamic space for exploration and interaction.

  • Ownership of Experiences: NETO retains full ownership of all 3D worlds and Experiences created and made available through the platform. Users are granted access to these Experiences for personal use while complying with these Terms and Conditions.
  • Usage of Experiences: As a user, you may interact with, explore, and participate in any Experiences made available by NETO. However, you may not copy, alter, or redistribute any part of the Experiences without explicit permission from NETO.
  • User-Generated Content in Experiences: While NETO designs the main 3D worlds, users may create and bring their own characters and objects into the Experiences. User-generated content remains the intellectual property of the user but must comply with all applicable rules, including restrictions on NSFW content and other prohibited activities.

8. Privacy and Data Use

Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

By using NETO AI, you consent to our privacy practices, including the collection and processing of your data as described in the Privacy Policy.

9. Termination of Account

NETO reserves the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms and Conditions or engaged in conduct detrimental to the service.

Upon termination, you will no longer have access to NETO AI, and any data associated with your account may be deleted, as outlined in our Privacy Policy.

10. Disclaimer of Warranties

NETO AI is provided “as is” and “as available.” We make no warranties, express or implied, regarding the service’s reliability, availability, or fitness for a particular purpose. You agree to use NETO AI at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law, NETO shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of NETO AI, including but not limited to loss of data, profits, or goodwill.

12. Indemnification

You agree to indemnify, defend, and hold harmless NETO, its affiliates, employees, and partners from any claims, damages, liabilities, and expenses arising from your use of NETO AI, including any violation of these Terms and Conditions.

13. Changes to Terms

NETO reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and the “Effective Date” will be updated accordingly. Your continued use of NETO AI after such changes constitutes your acceptance of the revised terms.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.
